Please read these Terms & Conditions carefully before purchasing a training package or booking a session with MovebyKim. By completing your purchase or booking, you confirm that you have read, understood, and agreed to the following terms.

1. Services MovebyKim offers personal training services, including 1:1 in-person training sessions, online programming, and access to the Everfit training platform. Sessions take place at the private training studio located at Brunnenweise 1, 8132 Egg, Zurich, or at agreed outdoor locations.

2. Health & Medical Disclosure By booking a session or purchasing a package, you confirm that:

• You are in adequate physical health to participate in exercise and physical training

• You have disclosed any known medical conditions, injuries, physical limitations, or medications that may affect your ability to train safely

• You have consulted with a qualified medical professional if you have any concerns about your readiness to exercise

• You will notify MovebyKim promptly of any changes to your health or physical condition that arise during your training program

MovebyKim reserves the right to modify, pause, or decline sessions if there are reasonable concerns about a client's health or safety.

3. Assumption of Risk You acknowledge that participation in physical exercise and personal training carries inherent risks, including but not limited to muscle soreness, strains, sprains, and in rare cases more serious injury. You voluntarily assume all such inherent risks associated with participation in training sessions and programs provided by MovebyKim.

4. Limitation of Liability To the extent permitted under Swiss law (in particular the Swiss Code of Obligations, OR), MovebyKim shall not be held liable for any injury, loss, or damage arising from your participation in training sessions or programs, except in cases of gross negligence or willful misconduct on the part of MovebyKim.

You are responsible for your own safety during all sessions and agree to follow all coaching instructions and safety guidance provided.

5. Outdoor Sessions Where sessions take place outdoors, you acknowledge that outdoor environments carry additional inherent risks including uneven terrain, weather conditions, and other external factors beyond the control of MovebyKim. You voluntarily assume these additional risks and agree that MovebyKim shall not be held liable for any injury or incident arising from outdoor environmental conditions.

6. Everfit Platform Access to the Everfit training platform is included with active training packages (10-, 15-, and 25-session packs) and standalone online programs. By accessing Everfit, you agree to comply with Everfit's own terms of use and privacy policy. MovebyKim is not responsible for any technical issues, data handling, or service interruptions attributable to the Everfit platform. Access to Everfit is valid only for the duration of your active package and will expire upon completion or cancellation of your package.

7. Cancellation & Rescheduling Policy A minimum of 24 hours notice is required to cancel or reschedule a session. Sessions cancelled with less than 24 hours notice may be forfeited without refund. MovebyKim reserves the right to cancel or reschedule sessions due to illness, emergency, or circumstances beyond her control, and will provide as much notice as possible in such cases.

8. Payments & Refunds Payment is due at the time of booking or package purchase. Training packages are non-refundable once purchased, except where required by applicable Swiss consumer protection law. Unused sessions within a package may be rescheduled but are not eligible for cash refund.

9. Privacy Your personal data, including health information provided to MovebyKim, will be treated confidentially and used solely for the purpose of delivering training services. MovebyKim will not share your personal information with third parties except where required by law or with your explicit consent, and will handle all data in accordance with applicable Swiss data protection legislation (nDSG).

10. Governing Law These Terms & Conditions are governed by Swiss law. Any disputes arising from the use of MovebyKim's services shall be subject to the jurisdiction of the courts of the Canton of Zurich.

11. Acceptance By purchasing a training package or booking a session, you confirm that you are 18 years of age or older, that you have read and understood these Terms & Conditions, and that you agree to be bound by them.
